The 14th “Lee and Li Cup” Chinese University Moot Court Competition Report

December 6th, 2016 the 14th annual “Lee and Li Cup” Chinese University Moot Court Competition was held at  Tsinghua University School of Law. Prof. Shen Weixing, Dean of the Tsinghua Law School, Mr Chen Changwen, Managing Partner of Lee and Li (Taiwan), and Director of The Lee and Li Foundation (Taiwan), Prof. Wang Chenguang, Direcor of “Lee and Li Cup” committee, and 40 top university teams, including from Peking University, Tsinghua Univeristy, Renmin University of China, China University of Political Science and Law, Southwest University of Political Science and Law, Shanghai Jiaotong University, Wuhan University, Jilin Univeristy, Shandong University, Suzhou University, and Zhongshan University, participated in the moot court competition. After 87 intense rounds of competition, the Tsinghua team emerged as the champion.

The “Lee and Li Cup” Chinese Universities Moot Court Competition was co-hosted by Tsinghua Law School and the Taiwan Lee and Li Foundation.The competition’s purpose is to attract a focus on legal education and legal issues. Meanwhile, it provides students with the experience of practical legal work beyond classroom learning. Through communication among different law schools, it is helpful for students in deep learning, capacity for work, and experience accumulation, and then promote critical thinking about legal issues.

the scene of the Preliminary

The legal topic of “Lee and Li Cup” Moot Court Competition varies each year. This year, the case was concerned with the purchasing pattern and administrative monopoly of a pharmaceutical group. In the preliminary round, 5 teams from each group participated in one round-robin match. In the group, every team would debate with the other 4 teams, and act as the appellant in two rounds, and then as the respondent in the other two rounds. The semifinals adopted an elimination format. The respondant and appellant would be decided by ballot in the finals, competing for the winner and runner-up. Meanwhile, scholars, judges, arbitrators and lawyers acted as the jury. They made comments on each team’s performance based on their rich practical experience.

Prof.Shen Weixing , Dean of the Tsinghua Law School, made a speech at the awards ceremony. He said that the “Lee and Li Cup” Moot Court competition has became the important component of our legal education, providing opportunities for practical legal experience, and a platform for improving students’ professional qualities. Mr. Chen Changwen from Taiwan Lee and Li remarked about the constitutional judicature of China. He explained the rule of law, legislation and the responbilities of lawyers, and encouraged our students to pursue their dreams bravely.

After the competition, Judge Lu Yao from the Beijing First Intermediate People's Court said that the training model of a moot court is very helpful. This model allows junior law students to experience the practice of law. And, regarding the senior students, the experience of moot court can help develop their potential, and provide some reference for career planning. “I gained a lot by diligently preparing for the “Lee and Li Cup” Moot Court Competition, my devotion to law is deeper and my plan for future clearer.” Xie Yuting from Tsinghua Team remarked.

The final 8 teams of 14th “Lee and Li Cup” Moot Court Competition were Southwest University of Political Science and Law, China University of Political Science and Law, Tsinghua University, Fuzhou University, Zhongshan University, Anhui Univerisity, Shanghai Jiaotong University, and South Central University for Nationalities. Among the student participants, Ni Ziyue from China University of Political Science and Law and Shan Wei from Tsinghua University won the title of “the Best Debater.”
